NEC have just published a guidance note on “conflict avoidance”. The guidance includes clauses that can be added to the contract to be able to intoduce a “Conflict Avoidance Panel” and the processes to be followed in the event of any such situations. This is an extension to the collaborative nature that NEC contracts are trying to encourage.
