The NEC User Group has just published an article I have written on the use of Z clauses, which also includes highlighting some of the nominations and winner of our “Z clause of the year award” at our 2025 NEC People annual conference.
It remains the case that whilst the principle of Z clauses themselves are not bad, they can be misused or misunderstood. Clients need to think about what they are writing and why they are writing them, and Contractors need to carefully consider their implications at tender stage and either negotiate, price the risk or walk away.
