NEC4 Key Dates and the financial liability for missing them

We have seen much debate in the industry on what the actual financial liability is for a Contractor under an ECC contract (or Subcontractor under ECS) for missing a Key Date.

Here this matter is considered in detail within this joint article from Rob Horne (Osborne Clarke) and Glenn Hide (GMH Planning) which explores from a contractual and legal perspective as to what a Client can and can NOT claim under the contract where a Contractor exceeds a Key Date. The answer may surprise a few people and the liability may not be as wide reaching as Client’s previously may have thought!
